Nowadays, you do not have to look too far to find stories about how people are relying upon the provisions of The Human Rights Act 1998 to ensure that their fundamental rights are being respected in one way or another. The Human Rights Act originated when the UK Government recognised the need for the articles of The European Convention on Human Rights (ECHR) to be entrenched more acutely into our legal system. Contrary to what many people may think, this was not a whole host of new legal provisions; instead, it was a mere consolidation of laws the UK had actually ratified many decades earlier.

A situation that has occurred in the work environment and that is a result of a willful action of an employer is known as constructive dismissal. This situation normally results in an intolerable working environment for an employee to continue employment. There is no other available option for the employee but a resignation from his or her position. When an employee files for constructive dismissal, he is accusing the employer of created an intolerable situation which resulted in him or her no longer being able to function under normal circumstance. The employee however needs to be able to provide proof that the actions of the employer were indeed intolerable and unacceptable to such an extent that this issues could not be resolved in any other way.
